Russia Intensifies Public Inspections and Starts Process of Mass Cancellation of Certificates and Declarations of Conformity

The Government of the Russian Federation issued a range of Decisions and Orders within implementation of the “Regulatory Guillotine” reform during 2021. The reform is aimed at improving the level of security and eliminating redundant administrative procedures through cancellation of outdated regulatory documents and via creation of a new effective public control (supervision) system.

Thus, in the middle of June 2021, Russia implemented the provisions of Federal Law No. 460-FZ amending the Federal Law "On Technical Regulation'' and Federal Law "On Amendments to Article 4 of the “Consumer Right Protection Federal Law.". One of the changes introduced in this Law concerns the inspection control procedure. Now if inspection control is not carried out in time, the validity of the certificate of conformity is canceled and a corresponding entry is made in the register of certificates of conformity and declarations of conformity.

Thus, certification bodies that issued certificates of conformity for mass-produced products must periodically assess the products in accordance with the requirements of the EAEU and the legislation of the Russian Federation and enter the relevant information about such assessments in the register of certificates of conformity and declarations of conformity.

At the moment, The Federal Service for Accreditation (RusAccreditation) is actively inspecting certification bodies and has already begun the process of mass cancellation of certificates and declarations of conformity. In case of any inconsistencies during the inspection, the RusAccreditation has the right to terminate or reduce the field of accreditation for a certain certification body. It can lead to an increase in:

  • workload of trusted certification bodies
  • time for issuance of certificates of conformity
  • cost of work

With this regard, the R-Group recommends manufacturers, distributors, and importers of goods:

  • to check the status of certificates/declarations of conformity in the FSA register
  • consider necessity for reissuance of certificates/declarations that could potentially fall under the scope of cancellation
  • work only with reliable certification bodies to avoid future problems
