EAEU Introduces New Packaging Safety Requirements

In September 2024, the EEC Council adopted Decision No. 61 "On Amendments to the Customs Union Technical Regulation 'On Packaging Safety' (TR CU 005/2011)".

This decision entered into force on 5 March 2025 and affected the following provisions:

1. Updated terminology

The terminology was harmonised in accordance with the Protocol on Technical Regulation within the EAEU and Customs Union Commission Decision No. 769.

2. New version of Article 3 "Rules of Circulation in the Union Market"

According to the new amendments, packaging (closures), upon confirmation of compliance with all applicable technical regulation requirements, must be marked with the Union market circulation sign.

3. New version of Article 4 "Ensuring Compliance with Safety Requirements"

Packaging (closures) must comply with the requirements of relevant standards and research methods specified in the Lists for TR CU 005/2011, updated in late July 2024.

4. New version of Article 7 "Conformity Assessment"

Five declaration schemes have been identified. Schemes 3d, 4d and 6d are intended to confirm the conformity of packaging for such products as:

• food products, including baby food
• perfumery and cosmetic products in direct contact with the packaged product
• toys and children's items in direct contact with a child's mouth

Schemes 1d and 2d are intended for other types of packaging. At the applicant's request, schemes 1d and 2d may be replaced with schemes 3d, 4d, 6d.

Schemes 1d, 3d and 6d are used for serial production and may be declared only by the manufacturer or its authorised representative.

Schemes 2d and 4d are intended to confirm the conformity of a batch of products, and in addition to the above persons, the seller or importer may also act as the applicant.

5. Article 9 is recognised as no longer in force.
